We are Paraiso de Cristina Private Resort ("Company," "we," "us," "our"), a
private
resort
registered in the Philippines at V. Pineda St., Sitio Banag Brgy. Cub-Cub, Capas, Tarlac 2315, Philippines.
We operate the website https://paraisodecristina.com
(the "Site"), as well as any other related products and services that refer or link to these legal terms (the
"Legal Terms") (collectively, the "Services").
The Services provide an online reservation system for guests to book accommodations and facilities
at
Paraiso de
Cristina Private Resort. The website is designed exclusively for reservation purposes and does not facilitate
direct online payment transactions.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on
behalf of an
entity ("you"), and Paraiso de Cristina Private Resort, concerning your access to and use of the Services. You
agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal
Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING
THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
These Legal Terms are governed by the laws of the Republic of the Philippines, including but not
limited to the
Civil Code of the Philippines, the Consumer Act of the Philippines (Republic Act No. 7394), and other applicable
laws and regulations.
We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms
at
any time
and for any reason. We will alert you about any changes by updating the "Last updated" date of these Legal
Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to
periodically review these Legal Terms to stay informed of updates.
All users who are minors in the jurisdiction in which they reside (generally under the age of 18)
must
have the
permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor,
you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.
1. OUR SERVICES
Paraiso de Cristina Private Resort provides an online reservation system that allows guests to:
- View available dates and resort facilities
- Create and manage reservations
- Receive booking confirmations and payment instructions via email
- Access information about the resort's amenities and policies
The Services are designed exclusively for reservation purposes. Payment is not processed directly
through the
website but through the payment methods communicated to you via email after your reservation is confirmed.
2. INTELLECTUAL PROPERTY RIGHTS
Our Intellectual Property
We are the owner or the licensee of all intellectual property rights in our Services, including all
source code,
databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the
Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein
(the "Marks").
Our Content and Marks are protected by copyright and trademark laws under Philippine law (Republic
Act
No. 8293 -
Intellectual Property Code of the Philippines) and treaties around the world.
The Content and Marks are provided in or through the Services "AS IS" for your personal,
non-commercial
use only.
Your Use of Our Services
Subject to your compliance with these Legal Terms, including the "PROHIBITED ACTIVITIES" section
below,
we grant
you a non-exclusive, non-transferable, revocable license to:
- Access the Services for the purpose of making reservations; and
- Download or print a copy of any portion of the Content to which you have properly gained access, solely for
your personal, non-commercial use related to your reservation.
Except as set out in this section, no part of the Services and no Content or Marks may be copied,
reproduced,
aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed,
sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written
permission.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete;
- You will maintain the accuracy of such information and promptly update such registration information as
necessary;
- You have the legal capacity and you agree to comply with these Legal Terms;
- You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental
permission to use the Services;
- You will not access the Services through automated or non-human means, whether through a bot, script, or
otherwise;
- You will not use the Services for any illegal or unauthorized purpose;
- Your use of the Services will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the
right to
suspend or terminate your account and refuse any and all current or future use of the Services (or any portion
thereof).
4. USER REGISTRATION
You may be required to register to use the Services. You agree to keep your password confidential
and
will be
responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a
username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or
otherwise objectionable.
5. RESERVATIONS AND BOOKING
Booking Process
When you make a reservation through our Services:
- You submit a reservation request through the website with your desired dates and resort facilities;
- You receive a booking confirmation email containing:
- Reservation details and confirmation number
- Total amount due
- Available payment methods (GCash and Bank Transfer)
- Payment instructions and deadline
- Account details for payment submission
- You complete payment using one of the provided methods within the specified deadline;
- You send proof of payment to our email address as instructed;
- We verify your payment and send final confirmation of your reservation.
Reservation Confirmation
Your reservation is not confirmed until we have received and verified your payment. We reserve the
right to
cancel any reservation for which payment has not been received within the specified deadline.
Booking Modifications
To modify or cancel a reservation, you must contact us via email at
paraisodecristinaprivatefarmresort@gmail.com
or by phone at 09453493917. Modifications are subject to availability and our cancellation policy.
6. PAYMENT PROCESS
Accepted Payment Methods
We accept the following forms of payment:
- GCash - Electronic wallet payment service
- Bank Transfer - Direct bank deposit or online bank transfer
IMPORTANT: The website does not process payments directly. All payment transactions are
completed outside of the website through the payment methods specified in your reservation confirmation email.
Payment Instructions
- After submitting your reservation, you will receive an email with detailed payment instructions;
- Complete payment using GCash or Bank Transfer to the account details provided in the email;
- Take a clear photo or screenshot of your payment receipt/proof of transaction;
- Send the proof of payment to paraisodecristinaprivatefarmresort@gmail.com with your reservation number in
the subject line;
- Wait for our confirmation email verifying receipt of payment and final reservation confirmation.
Payment Terms
- All payments shall be in Philippine Peso (PHP);
- Payment must be received within the deadline specified in your reservation confirmation email;
- Failure to provide proof of payment within the deadline may result in automatic cancellation of your
reservation;
- You agree to pay all charges at the prices then in effect for your reservations;
- We reserve the right to correct any errors or mistakes in pricing, even if we have already confirmed your
reservation.
Verification Process
We will verify all payments within 24-48 hours of receipt. Once verified, you will receive a final
confirmation
email. Please ensure that:
- Your proof of payment clearly shows the transaction date, amount, and reference number;
- The amount paid matches exactly the total stated in your reservation confirmation;
- Your reservation number is included in your email subject line when sending proof of payment.
7. CANCELLATION AND REFUND POLICY
Please review our Cancellation and Refund Policy available at https://paraisodecristina.com/Policies.
This policy is governed by the Consumer Act of the Philippines (Republic Act No. 7394) and other
applicable laws
protecting consumer rights.
Cancellation by Guest
To cancel a reservation, you must notify us in writing via email or phone as outlined in our
Cancellation Policy.
Cancellation fees and refund eligibility will be determined based on the timing of your cancellation request.
Cancellation by Resort
We reserve the right to cancel any reservation in the event of:
- Non-payment within the specified deadline;
- Force majeure events (natural disasters, government orders, etc.);
- Violation of these Legal Terms;
- Resort maintenance or emergency situations.
In such cases, we will provide full refund of any payments received, unless the cancellation is due
to
your
violation of these Legal Terms.
8. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the
Services
available.
As a user of the Services, you agree not to:
- Systematically retrieve data or other content from the Services to create or compile a collection,
compilation, database, or directory;
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account
information;
- Circumvent, disable, or otherwise interfere with security-related features of the Services;
- Make any unauthorized use of the Services, including creating user accounts by automated means or under
false pretenses;
- Use the Services to make fraudulent reservations or bookings;
- Provide false or misleading information in your reservation details;
- Submit fraudulent or altered proof of payment;
- Engage in any activity that disrupts or interferes with the Services;
- Use the Services in violation of any applicable Philippine law or regulation;
- Attempt to bypass any measures of the Services designed to prevent or restrict access;
- Harass, abuse, or harm another person, including resort staff or other guests;
- Use the Services for any commercial purpose without our express written permission.
9. RESORT RULES AND REGULATIONS
By making a reservation through our Services, you agree to comply with all resort rules and
regulations
during
your stay, including but not limited to:
General Conduct
- Respect for other guests and resort staff;
- Adherence to designated check-in and check-out times;
- Proper care and use of resort facilities and property;
- Compliance with noise regulations and quiet hours;
- Prohibition of illegal activities on resort premises.
Safety and Security
- Guests are responsible for their personal belongings;
- Swimming and water activities are at guests' own risk;
- Children must be supervised by adults at all times;
- Follow all posted safety guidelines and instructions from resort staff.
Property Damage
Under Article 2199 of the Civil Code of the Philippines, you shall be liable for any damage to
resort
property
caused by you or your guests during your stay. We reserve the right to charge your payment method for any
damages or require immediate payment.
Liability for Injuries
In accordance with Article 2180 of the Civil Code of the Philippines, you are responsible for
injuries
caused to
others by persons under your care or custody while on resort premises.
10. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to:
- Monitor the Services for violations of these Legal Terms;
- Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal
Terms;
- Refuse, restrict access to, limit the availability of, or disable any reservation request;
- Remove from the Services or otherwise disable any content that we determine to be inappropriate or violates
these Legal Terms;
- Otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the
proper functioning of the Services.
11. PRIVACY POLICY

By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into
these
Legal Terms
and complies with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines.
The Services are hosted in the Philippines. If you access the Services from any other region of the
world with
laws or other requirements governing personal data collection, use, or disclosure that differ from applicable
laws in the Philippines, then through your continued use of the Services, you are transferring your data to the
Philippines, and you expressly consent to have your data transferred to and processed in the Philippines.
12. TERM AND TERMINATION
These Legal Terms shall remain in full force and effect while you use the Services. WITHOUT
LIMITING
ANY OTHER
PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY,
DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON
OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED
IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION.
We may terminate your use or participation in the Services or delete your account and any content
or
information
that you posted at any time, without warning, in our sole discretion.
If we terminate or suspend your account for any reason, you are prohibited from registering and
creating a new
account under your name, a fake or borrowed name, or the name of any third party. In addition to terminating or
suspending your account, we reserve the right to take appropriate legal action, including without limitation
pursuing civil or criminal redress under Philippine law.
13. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Services at any time or for
any
reason at
our sole discretion without notice. However, we have no obligation to update any information on our Services. We
also reserve the right to modify or discontinue all or part of the Services without notice at any time.
We will not be liable to you or any third party for any modification, price change, suspension, or
discontinuance
of the Services.
We cannot guarantee the Services will be available at all times. We may experience hardware,
software,
or other
problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors.
You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability
to access or use the Services during any downtime or discontinuance of the Services.
14. GOVERNING LAW
These Legal Terms shall be governed by and construed in accordance with the laws of the Republic of
the
Philippines, including but not limited to:
- The Civil Code of the Philippines
- The Consumer Act of the Philippines (Republic Act No. 7394)
- The Electronic Commerce Act of 2000 (Republic Act No. 8492)
- The Data Privacy Act of 2012 (Republic Act No. 10173)
- Other applicable laws and regulations of the Philippines
Paraiso de Cristina Private Resort and yourself irrevocably consent that the courts of the
Philippines
shall have
exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.
15. DISPUTE RESOLUTION
Informal Resolution
To expedite resolution and control the cost of any dispute, controversy, or claim related to these
Legal Terms,
you and we agree to first attempt to negotiate any dispute (except those disputes expressly excluded below)
informally for at least thirty (30) days before initiating any arbitration or court proceeding.
Binding Arbitration
If informal resolution fails, any dispute arising out of or related to these Legal Terms shall be
resolved
through binding arbitration in accordance with the Alternative Dispute Resolution Act of 2004 (Republic Act No.
9285) of the Philippines.
Exceptions to Arbitration
The following disputes are not subject to arbitration:
- Any disputes seeking to enforce or protect intellectual property rights;
- Any claim for injunctive relief;
- Any dispute involving criminal activity.
Jurisdiction
You agree to submit to the personal jurisdiction of the courts located in Tarlac, Philippines for
the
purpose of
litigating all such disputes that are not subject to arbitration.
16. LIMITATIONS OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES,
OR
AGENTS BE
LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR
PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF
THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE
WHATSOEVER AND
REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR
THE SPECIFIC RESERVATION GIVING RISE TO THE CLAIM.
This limitation of liability is subject to mandatory provisions of Philippine law, including
consumer
protection
laws that may not permit certain limitations of liability.
17. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and
all
of our
respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or
demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:
- Your use of the Services;
- Breach of these Legal Terms;
- Any breach of your representations and warranties set forth in these Legal Terms;
- Your violation of the rights of a third party, including but not limited to intellectual property rights;
- Any overt harmful act toward any other user of the Services or resort guests with whom you connected via the
Services;
- Any damage to resort property or injury to persons caused by you or persons under your care during your stay
at the resort;
- Your violation of any Philippine law or regulation.
18. MISCELLANEOUS
Entire Agreement
These Legal Terms and any policies or operating rules posted by us on the Services constitute the
entire
agreement and understanding between you and us.
Waiver
Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as
a
waiver of
such right or provision.
Severability
If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or
unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not
affect the validity and enforceability of any remaining provisions.
Assignment
We may assign any or all of our rights and obligations to others at any time. You may not assign or
transfer your
rights or obligations under these Legal Terms without our prior written consent.
Force Majeure
We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any
cause beyond
our reasonable control, including but not limited to acts of God, natural disasters, government actions, war,
civil commotion, or any other force majeure event as defined under Philippine law.
Electronic Communications
Visiting the Services, sending us emails, and completing online forms constitute electronic
communications. You
consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other
communications we provide to you electronically, via email and on the Services, satisfy any legal requirement
that such communication be in writing, in accordance with the Electronic Commerce Act of 2000 (Republic Act No.
8792) of the Philippines.
ACKNOWLEDGMENT
BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE LEGAL TERMS AND AGREE TO BE
BOUND
BY THEM. IF
YOU DO NOT AGREE TO THESE LEGAL TERMS, PLEASE DO NOT USE THE SERVICES.
